Shorward is operated by Media Yard LLC, PO Box 73, Pennsauken, NJ 08110, USA. In these terms, "we" means Shorward and "you" means the person or organization using the service. If you accept these terms for an organization, you confirm you're authorized to bind it.
1. The service
Shorward scans publicly reachable endpoints and evidence you upload, and reports post-quantum readiness using our published rating method. The service is informational reporting only. It is not security, legal, compliance or financial advice, and it is not a certification, audit or guarantee against breach.
2. Private beta
The service is in private beta. Features may change, be limited or be withdrawn. Beta access is free unless we agree otherwise in writing. We'll tell you before any paid plan starts, and nothing is charged without your agreement.
3. Accounts
Give accurate information and keep your login secure. You're responsible for activity under your account. Tell us promptly at [email protected] if you think it has been misused.
4. Domains and authorization
You may only add domains that you own or are authorized to have assessed. Continuous monitoring runs only on domains verified by a DNS record. You must follow our Acceptable Use Policy.
5. Your content
You keep all rights in what you upload, such as CBOMs, configuration exports and roadmaps. You give us a limited licence to process it only to provide the service to you. Where we process personal data on your behalf, our Data Processing Addendum applies.
6. Reports and ratings
Reports describe what we measured at a point in time. Endpoints and configurations change, so a result can go out of date the moment after a scan. You decide whether to publish a rating. If you do, you may share the report and badge as issued, but not in an altered form, and not after it has lapsed.
7. Fees
Paid plans, when they open, are billed monthly in advance at the price shown when you subscribe, plus applicable taxes. You can cancel at any time. Cancellation takes effect at the end of the current billing period. Fees already paid aren't refunded, except where the law requires it.
8. Our rights
The service, the rating method, the Shorward name, logo and badges belong to us. You may not copy, resell or reverse engineer the service, or use it to build a competing product.
9. Suspension and termination
You can stop using the service at any time. We may suspend or end access if you breach these terms or the Acceptable Use Policy, or if we must to comply with law. When access ends, we delete your content as described in the Privacy Notice and the DPA.
10. Disclaimers
The service is provided "as is" and "as available", especially during the beta. To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We don't warrant that scans find every issue or that results are error-free.
11. Limitation of liability
To the extent the law allows, neither party is liable for indirect, incidental, special or consequential losses, or for lost profits, revenue or data. Our total liability for all claims in any 12-month period is limited to the greater of the fees you paid us in that period and US$100. Nothing in these terms limits liability that can't be limited by law, such as for fraud, death or personal injury caused by negligence.
12. Indemnity
You'll defend and indemnify us against third-party claims that arise from domains or content you added without authorization, or from your breach of the Acceptable Use Policy.
13. Changes
We may update these terms. We'll post the new version here with a new date, and give at least 30 days' notice by email of changes that materially reduce your rights. Continuing to use the service after the change takes effect means you accept it.
14. Law and disputes
These terms are governed by the laws of the State of New Jersey, USA, and the state and federal courts located in New Jersey have exclusive jurisdiction. If you're a consumer in the UK or EU, you also keep the protection of the mandatory laws of your country of residence and can bring claims there.
15. General
These terms, together with the policies they link to, are the whole agreement between us about the service. If a provision is unenforceable, the rest still applies. Neither party may assign the agreement without the other's consent, except in a merger or sale of substantially all its assets. Contact: [email protected].
